1. Acceptance of Terms
By accessing or using the OurWork platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
2. Description of Service
OurWork is a business management platform designed for service professionals. The Service includes customer management, job scheduling, quoting, invoicing, payment processing, and notification features.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service in any way that could damage, disable, or impair the Service or interfere with any other party's use.
4.1 SMS Messaging — Your Responsibility
When you enable SMS notifications for a customer in the Service, you represent and warrant that you have obtained the customer's prior express consent to receive transactional SMS messages at the phone number you provided. You must only mark "SMS consent" on the customer record when the customer has explicitly agreed — verbally, in writing, or via your booking flow — to receive automated text messages from your business in connection with the services you provide them.
The Service sends only transactional messages (appointment reminders, on-the-way alerts, invoices, payment reminders, quote follow-ups, and job status updates). You may not use the Service to send marketing, promotional, political, or any non-transactional SMS content. You agree to comply with the TCPA, CAN-SPAM, CTIA Messaging Principles & Best Practices, and all applicable carrier and regulatory requirements for SMS messaging.
We will immediately and permanently suspend SMS sending to any recipient who replies STOP (or any equivalent opt-out keyword). Repeated complaints, spam reports, or carrier violations may result in suspension or termination of your account.
5. Payment Terms
Paid plans are billed monthly. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. Refunds are handled on a case-by-case basis.
6. Data Ownership
You retain full ownership of all data you enter into the Service, including customer information, job details, invoices, and quotes. We do not claim ownership of your content.
7. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability, and we will provide advance notice when possible.
8. Limitation of Liability
To the maximum extent permitted by law, OurWork shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
9. Termination
We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting us. Upon termination, you may request an export of your data.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance.
